Terms of use
These are terms of use of the website — not of the cloud service. They assume an informational website (presentation + contact form), with no account or transaction.
1. Purpose and acceptance
These terms govern access to and use of the schengencloudalliance.eu website (the "Website"), published by Clever Cloud S.A.S. on behalf of the Schengen Cloud Alliance grouping. By accessing or using the Website, you accept these terms in full.
2. Nature of the Website — no contractual offer
The Website is provided for information purposes only and presents the alliance and the services offered by its members. Its content does not constitute a contractual offer, a warranty or a commitment of any kind. "Schengen Cloud Alliance" is not a separate legal entity and does not itself provide services or contract under its own name. Access to, subscription for and use of any cloud service are governed exclusively by the separate agreements concluded with the relevant entity (in particular POST Telecom S.A. and/or Clever Cloud S.A.S.), which alone determine the applicable rights, obligations, service levels and liabilities. In the event of any discrepancy, those agreements prevail over the content of the Website.
3. Access to the Website
The Website is accessible free of charge; you are responsible for the equipment, software and connection enabling access. The publisher may at any time and without notice modify, suspend or discontinue all or part of the Website (in particular for maintenance or technical reasons) without incurring liability.
4. Intellectual property
All elements of the Website (text, visuals, layout, databases) are protected under intellectual property law. The trademarks and logos of POST Telecom (deep), Clever Cloud and OVHcloud are the property of their respective holders and are used with their authorisation. Any reproduction, representation, adaptation or use, in whole or in part, without prior written authorisation is prohibited.
5. Acceptable use
You undertake to use the Website in accordance with applicable law and these terms. In particular, you must not attempt to gain unauthorised access to the Website or its hosting systems, disrupt or impair its operation or security, carry out automated extraction (scraping) other than as permitted by law, or use the Website for any unlawful, fraudulent or harmful purpose.
6. Hyperlinks
The Website may contain links to third-party websites not under the publisher's control. The publisher is not responsible for their content, availability or practices, and the presence of a link does not imply any endorsement.
7. Personal data and cookies
The processing of personal data and the use of cookies are described in the Privacy policy and the Cookie policy, which form an integral part of these terms.
8. Liability
The publisher endeavours to ensure that the information on the Website is accurate and up to date but gives no warranty as to its completeness, accuracy or timeliness, and the information may change at any time. To the fullest extent permitted by applicable law, the publisher shall not be liable for any direct or indirect damage arising from access to, use of, or inability to access the Website. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law.
9. Governing law and jurisdiction
These terms are governed by French law. Failing an amicable settlement, any dispute relating to the Website or these terms shall be submitted to the competent courts of Nantes subject to any mandatory rule of jurisdiction.
10. Changes and contact
These terms may be updated at any time; the applicable version is the one published on the Website at the date of access. For any question relating to these terms, contact contact@schengencloudalliance.eu.
